VA - A foreigner's (first) attempt at a "good governance" redistricting map for Virginia

Dear all,

This is the first time I've tried using Dave's App and making a redistricting map. I'm hoping you could tell me what things I've done wrong. (For one, I've kept the population of each district very close to the target population, 3,000 off at most, because I didn't know just how close you have to keep it. Could I have been more flexible?)

This is the map, but please do read on:

First off, I had an idea with this map. Most of the redistricting maps here are drawn, with great expertise, to either create the most realistically (or unrealistically) Democratic-friendly map; or, in a know-your-enemy / worst-case-scenario kind of way, the most GOP-friendly map; or the map that best fits the current political realities of the state, trying to guess what the real map will end up being.

Since I have nowhere near enough expertise to weigh in, I've just been observing, with some awe. But, as a foreigner, I still have trouble getting over my initial incredulity at the whole American practice of gerrymandering in the first place. The kind of gerrymandering that yields these sometimes mindbogglingly contorted looking districts, tracing unlikely looking paths from, say, the suburbs of one city to those of another halfway across the state, often seemingly without regard to keeping communities together. It's one of the oddest and unhealthy looking aspects of the US political system, for an outsider.

I'm from a country where we don't have any districts at all (it's all PR), and both in my adopted home country and the big European countries I know best (Germany, the UK), nothing like this kind of gerrymandering seems to exist. And often when I see the draft maps here, I can't help fantasizing about what a redistricting map purely based on good governance would look like. (I'm really curious what the new CA and FL maps will look like!)

That said, among the many things I have learned about on SSP is the VRA, and I approve. I don't like the 60+% black/hispanic vote sinks that segregate the minority altogether and allow the VRA district incumbent practically guaranteed re-election. But I have totally embraced the need for districts in which minority group candidates are favoured, so minority groups are represented more proportionally in Congress. It's history's bill: it would be great if a black candidate stood as good a chance to be elected anywhere, but the reality is that in too many parts of the country, black/hispanic candidates will only be elected in black/hispanic-majority districts.

I wanted to draw my ideal "good governance" map for a state, the way it would look if there were no bothersome laws, legislative majorities or incumbencies to take account of.

I drew up these criteria:

  1. The number of districts that lean one way or another politically should be roughly proportionate to the parties' general share of the vote. (E.g.: don't stack all the voters of one party into two districts so the other party can easily win in five, when the two parties get about equal amounts of votes altogether).
  2. There should be a number of districts where a minority group candidate would be favoured roughly proportional to the group's share of the overall voting age population. However, districts in which a minority group makes up a small majority (<55%) or a mere plurality, and "coalition" districts in which minorities together outnumber whites should be preferred over segregating individual minorities in 60%+ vote sink districts.
  3. There should be as many competitive districts as possible, both to avoid safe incumbents coasting to victory without having to worry about accountability; and to keep the number of those whose vote doesn't "count" because their party is irrevocably in opposition to a minimum.
  4. Districts should be compact and keep communities of interest together.
  5. While uniting communities of interest is good, it is not beneficial for public policy if the residents of cities and surrounding suburbs are pitted against each other. (A story that struck me was the fight, at a state level I imagine, over public transport in Atlanta, in which the residents of the suburbs managed to block the extension of the city's public transport system because they feared that it would just bring more blacks into their neighbourhoods.) The map should draw cities and surrounding suburbs into common districts where possible.

As you will recognize, but I didn't quite realize beforehand, some of these points make some of the others impossible. Applying point 2 in particular throws a spanner in the works when it comes to points 4 and 5. Creating that many minority-majority districts means contorted shapes, and splitting off black or hispanic city neighbourhoods. Since minority voters tend to vote Democratic, creating more minority districts also means creating more safe Democratic districts, so it's a problem with point 3 too.

Virginia turns out to neatly illustrate all this. My other problem is that I know little about Virginia, so it's hard for me to guess where communities of interest lie exactly in any case. (Any feedback much appreciated.)

(All these data from within Dave's app. I noticed that if you download the data on race by congressional district (18+ population, hispanic and non-hispanic by race) from the census site, there's slight variations, though never more than 1% up or down.

How does this stack up with my criteria?

  1. Fulfilled: My redistricting map creates six Republican districts, four Democratic districts, and one Democratic-leaning district.
  2. Fulfilled: The map creates two districts in which a minority group has a plurality (blacks in VA-3 and VA-4) and a third district in which the minority groups together outnumber non-hispanic whites (VA-11). (I tried to group together disproportionally hispanic towns and neighbourhoods in VA-11, so there's at least one district where they make up as much as 23% of the VAP - as close to having a district of their own as possible.) That's three minority-favoured districts compared to one now. Pitfall: while non-hispanic whites make up no more than 45% of each of these districts' VAP, they are 43%-45% in each, meaning that disparate turnout rates could also end you up with no minority Congressmen at all. Unlikely in an Obama year, but a concern otherwise.
  3. Failed: My redistricting map actually makes most districts less competitive. This is due to applying point 2. In order to create two more minority-favoured districts, I had to take black votes out of largely white districts, shoring up Republican majorities there. I also took some from the existing minority-majority VA-03, a Democratic vote sink - but that means that instead of having one D+38 district in the south, I ended up with two, still safe D+17-23 districts. Same in the north - by taking black and hispanic precincts from VA-8, I reduced that Democratic vote sink from D+32 to a still safe D+19, while creating an additional safe Democratic seat in VA-11 (D+18). All in all, I went from four arguably toss-up seats (VA-2, VA-4, VA-5 and VA-10) to one (VA-10).
  4. Partial: In the Northeast and the Southeast, districts are pretty contorted looking because of heeding point 2 (though I did manage to cut VA-03 short of stretching all the way up into Richmond neighbourhoods). Elsewhere, some districts are reasonable compact (VA-05 and VA-09, as well as VA-10 up north), but VA-1 stretches a long way across the state... How could this be done better, and do these districts unwittingly split any communities of interest?
  5. Partial: Creating three minority-favoured districts meant splitting a number of cities, in particular Richmond, but also Norfolk, Hopewell, Danville and Franklin - plus the agglomeration in NoVa.

A few points of response:

Re: Gerrymandering -- You're definitely right about the international context here. The US is, to the best of my knowledge, the only democracy with single-member districts that (largely) treats district line-drawing as a political rather than technical matter. This is related, I believe, to the American tradition of the spoils system.

Re: Good governance -- The rough framework of your map fits that description, but I'd quibble with a quite a number of your decisions. For example, breaking local boundaries with VA-11 in Arlington and Alexandria really isn't necessary. You can get entirely comparable results while staying outside of those jurisdictions. US House districts are so large that you really have to move around 100k people or more to make a substantial impact on the demographics.

Re: Minority representation -- US law is very difficult for a layperson to apply well. This is particularly so right now with regards to the laws protecting the rights of minorities in political representation (usually shorthanded as "VRA" around here). But so far as I understand it, your three minority districts aren't quite applying the standards correctly. With the two southern African-American districts, you really need to get them up to 50%+1 African American, using the Voting Age Population statistics, if at all possible. (I myself haven't quite figured out how to do that yet.) And with your northern district, there's no legal requirement for creating a district that's minority white just for the sake of doing so -- especially in a context where there's not significant partisan polarization by race. Politically, the district could be drawn if the relevant actors decided they wanted it, but it's not required. And in the context of Northern Virginia, I don't think that district is any more (or less) likely to elect a racial minority than your neighboring VA-08.

Re: Population deviation -- The official standard is zero deviation. I generally won't present a map on the site that's worse than +/- 999.

Re: Partisan +/- numbers -- You're not using the R+X and D+X notation in accordance with the standards for that convention. It's drawn from Cook Partisan Voting Index, which a comparison of how well the two major parties did in a particular jurisdiction in the last two presidential elections compared to how well they did nationally in the last two presidential elections. Dave's App doesn't give us all of the information we need to calculate that, so we generally make what I call 8PVI, which is a comparison of how the two parties did in a given jurisdiction in the 2008 presidential election compared to how well they did nationally in the 2008 presidential election.

For example, in 2008 in your VA-09, McCain won 60.3% of the two-party vote while Obama won 39.7%. Nationally, Obama won ~53.5% of the two-party vote while McCain won ~46.5%. This means that your VA-09 has an 8PVI of R+24, not R+20 -- that is, McCain did 24 points better there than he did nationally.

I haven't seen anyone make us of the 2000-2009 averages to make a comparable stat yet. Since we don't know what races went into that stat, we can't compare nationally. But by analogy, we could compare to Virginia as a whole. According to the App, Virginia as a whole voted 50.9% Republican in the 00-09 average (and therefore 49.1% Democratic). Your VA-09 voted 43.1% Democratic and 56.9% Republican over the same time span. That would make it's VA 00-09 PVI R+6 -- that is, on average the Republicans did 6 points better in your VA-09 than they did in Virginia as a whole.

Your point about minority representation
is very much up for debate. The diarist has created two downstate coalition districts in place of one majority black district. The jury is still out on whether such districts are equal in the eyes of the VRA. I think they may well be. However, we do know that "crossover districts" which are majority white cannot be.

My description of the state of the law is very debatable. Trying to pull together all of the different threads of VRA-related jurisprudence is very difficult.

I'm pretty sure that I agree with you that the downstate coalition districts should pass muster (especially from a "what's fair" perspective as opposed to a "what's legal" one). Whether or not (1) they would survive court challenge if put in place by the state government or (2) they could be drawn by court order under the provisions of VRA is unclear.

Re: gerrymandering -- A spoils system is definitively in place here (in Hungary) too, more so than in the US even I'm sure - but somehow it hasn't extended to the process of setting parliamentary district boundaries yet. Though with the current government, it's surely only a matter of time...

Re good governance -- Good point about Arlington and Alexandria city lines - there's not even that many precincts involved, so I'll try redrawing the map accordingly. What other decisions would you quibble with, leaving aside the by definition distorted shapes of the two minority-majority districts in the south?

Re minority representation -- Thank you very much for the additional info about the legal requirements about VRA districts. It is possible to draw two districts with 50%+1 black VAP in the south, but it looks .... scary: SSP user Sawolf just did it.

Mind you, I did say that I was trying to create the ideal map if laws, legislative majorities and incumbencies did not stand in the way, but I do appreciate your pointers, because pie-in-the-sky redistricting only goes so far. If you'll excuse my ignorance, though, what are the minority-majority  and "coalition" districts that I've seen mentioned here? Those don't involve 50%+1 majorities by one group, right, but that does that mean they don't fall under the VRA? Are they more of a voluntary thing, then? Would my three minority-plurality districts qualify as those?

Re: Population deviation -- Holy crap, that's tight. Count that as another step increasing my understanding for the weird shapes of US districts - it's hard to get them that close to target without compromising the integrity of towns, counties etc..

Re: Partisan +/- numbers -- Again, thank you very much for the added info. I just used the two datasets that were available in Dave's App, but I confess I never really grasped the PVI thing ... now I do. Will use PVI (or rather, 8PVI) properly next time!

Interestingly, the Federal workforce is (theoretically)
insulated from partisan hiring. That's a product of the Pendleton Act.

As for VRA districts, here is the nutshell taxonomy:

1. "Pure" VRA districts (one minority group is a majority of the VAP);

2. "Coalition districts" (the minority VAP is greater than 50%);

3. "Crossover districts" (while the majority is white, a substantial minority of white voters will reliably vote for minority-preferred candidates).

(1) is clearly protected by the VRA. (2) is probably protected (and also probably legally equivalent to (1)). (3) is outside of the scope of the VRA (see Bartlett v. Strickland).

On both counts. :)

So on my map I have no "pure" VRA seats, but I have three "coalition" districts - which are legally roughly equivalent. I can live with that. :-)

One of my personal good governance ideals would in any case be to have lots of districts where minorities together make up a majority, but few where one minority group makes up a large majority - for the same reason as I dislike overwhelmingly safe seats in general, it's not good for accountability.

Of course, in practice, creating three "coalition" districts instead of one "pure" VRA district the way I did would, I assume, be fiercely opposed by both the Republicans and the black Democrat currently holding VA-03...

Well, one thing to keep in mind about the deviations is that laws aren't self-enforcing. Someone has to care about a potential legal violation enough to sue the government about it and then has to win their case. Several states (Iowa and Arkansas come to mind) have traditionally ignored the Supreme Court's mandate of zero deviation and drawn their districts strictly according to county lines. They still try to get the deviations as low as possible but not zero. And those plans have held up because no one has been bothered enough by them to challenge them.

Quibbles
When I say quibble, I really do just mean little nitpicky things. The point about Arlington and Alexandria can be expanded to a number of different places on your map -- the split in Danville, having both Fluvanna and Buckingham Counties split between VA-05 and VA-07, having both King William and Caroline Counties split between VA-01 and VA-07, etc.

My perspective is informed by being a Michigander. Our own redistricting standards put a very high emphasis on respecting local boundaries, which I've definitely internalized. And so I give that element of what "fair districts" means more weight than some others do.

My own most recent attempts at what I would consider to be "fair districts" looks like this:

Both of my southern minority-majority districts are majority African-American by total population, although (like yours), they fall below on VAP.

If I were trying to import a measure of statewide partisan proportionality to the map, I'd switch Northern Virginia around like this:

Which makes all three NoVA districts about 60-40 Obama jurisdictions, which is D+7 in 8PVI. I'd also look at splitting VA-05 and VA-06 into a western (Shenandoah) district and an eastern (Piedmont) district instead of the shown north-south split. If I remember correctly, that makes VA-06 more Republican and VA-05 more Democratic.

This is a superb exploration
of the various competing imperatives that one generally considers when attempting to draw a fair redistricting plan. At first glance, I think this is a very fair map, and not far from what one might expect in a neutrally-conducted process (which Virginia will NOT have).

As to your question about population deviation, in fact, you have gone well beyond what is permitted for Congressional redistricting. In the 2000s, Pennsylvania's map was rejected (and had to be adjusted) because of a population difference of fewer than 100 people per district. There is more leeway in state legislative maps (but not as much as some people think, see Larios v. Cox).


Re: the various competing imperatives
Yes, this exercise has definitely confronted me with the various competing imperatives that are involved in a way that just looking at these maps never did.

While I still don't like gerrymanders in principle, doing this has increased my understanding for how these contorted shapes of districts come about, and may often be necessary, a lot.

Re population deviation, yikes. Having to keep the difference down to the hundreds or even just tens definitely complicates matters even further.

For a legal map, I would be wary
of having a population difference greater than 5 people. When you are drawing a real map, you can split precincts. Dave's app doesn't allow this.

Interestingly, that isn't true for State Legislature maps.
Most states mandate that the most and least populated district have a difference of less than 1,2 or 5% of the average district population.
