NY-13: Fossella Busted on DWI Charges

Holy smokes:

Rep. Vito J. Fossella (R-N.Y.) was arrested overnight in Alexandria and charged with driving while intoxicated, court records showed today.

Fossella is scheduled to appear in Alexandria General District Court on May 12 for an advisement hearing, the records said.

No other details were immediately available.

Reached by phone, Fossella's communication director had no immediate comment on the report.

More as we get it.  Fossella was already facing a potentially competitive re-election campaign this fall.

Rehab Maybe?
Maybe Vito can pull a Patrick Kennedy and go into rehab for a while.  

Kennedy was a Dem in a D+16 district
I don't think Fossella will be able to pull off the same as a Republican in a D+1 district.  I only wish we had a Staten Islander running on the Democratic side.  We've currently got two Brooklynites running, one of whom doesn't live in the district.

republicans wouldn't want to throw their golden boy, last man NYCer standing (and my girlfriend's congressman) under the bus....

of the 'two brooklynites', i might point out, we do have a pretty clear choice between the progressive Steve Harrison and the distasteful Domenic Recchia (who is rumored to have sabotaged the heroic labor leader Frank Barbaro's run for the same district).

i have a good feeling about this race being our 4th new york pickup this season - a scandal in a lean-dem district? its ours for the taking

this isn't that big a scandal all things considered.

And while Recchia may by distasteful, she's got a hell of a lot more money.

In terms of Congressional scandals.... I mean, he didn't choke a mistress... He wasn't arrested in a bathroom stall... It wasn't discovered that he had inappropriate internet relations with a minor.... I mean... Does this even really COUNT as a scandal in Congress? Or just another Tuesday?

In Wisconsin, and as you know, WI is a place where DUI's may actually help in the general rather than hurt. Problem there was that it was with a public vehicle, but this is delicious all the same.

which doesn't make him any more or less distasteful.

ya know, it's funny, i used to be the kind of guy who would support the more progressive candidate NO MATTER WHAT. and yes, that does mean that i was marching along side nader's running mate two days before getting arrested at the republican convention in '04. ever since the dems won on an anti-war platform in '06, and obama brought me under the party's tent, i've been seeing things differently.

if i was looking at a district in another state, i would be more inclined to support the elected official who's raising lots of money. but knowing that that same official has hurt our chances in previous elections... and since i'm intimately involved in local races where it'd be great to have a progressive congressman possibly endorsing the more progressive candidate, rather than another selfish machine creature... i have to side with harrison

anybody know
the rules of the house regarding when and uder what circumstances members are not allowed to continue serving. I know Kennedy (D-RI) still stayed in the house and retained his seat in 06, but i seem to rember a fuss about Bob Ney still sitting in the house, even though he had been indicted. So is it that you can still serve after an arrest, but not if you have been indicted? anybody?

I think
you can stay on if you're indicted, but not if you're convicted of a felony.

Ney's crimes were a lot worse in the eyes of
the House.  That's why people were complaining that he was still there.

...driving under the influence should be minimized in importance, but you're right.  Ney's crimes involved abuse of his office.  Plus, he was chairman of the House Administrative Committee.

His BAC was .17... more than double the legal limit

He could actually face little jailtime for this.  A .17 ain't a little buzz, it's shitface drunk.  Definately not good news for Fossella.
